These Terms of Service (“Terms”) govern your access to and use of the ComfortLore.com website (the “Site”), and any purchase of products from ComfortLore LLC (“ComfortLore,” “we,” “our,” or “us”). By accessing the Site or purchasing any product, you agree to be bound by these Terms. If you do not agree, you may not use the Site or purchase products.
1. Eligibility and Acknowledgment of Research Use
By accessing this Site or purchasing any product, you represent, warrant, and acknowledge that:
(a) You are at least 21 years of age and of legal age in your jurisdiction to purchase research chemicals;
(b) You are a qualified researcher, scientist, laboratory professional, or representative of a research institution acting in your professional capacity;
(c) All products purchased will be used solely for legitimate laboratory research, in vitro experimentation, analytical reference, and scientific study purposes;
(d) You will not consume, ingest, inject, inhale, or apply any product to humans or animals under any circumstances;
(e) You will not resell, redistribute, or otherwise transfer products to third parties for human or animal consumption;
(f) You assume full responsibility for ensuring that your use, storage, handling, and disposal of products complies with all applicable federal, state, and local laws, regulations, and ordinances in your jurisdiction.
If you cannot make these representations truthfully, you are not authorized to use this Site or purchase our products.
2. Research Use Only (RUO)
ALL PRODUCTS SOLD BY COMFORTLORE ARE STRICTLY FOR LABORATORY AND ANALYTICAL RESEARCH USE ONLY. PRODUCTS ARE NOT:
(a) Approved by the U.S. Food and Drug Administration (FDA), European Medicines Agency (EMA), or any other regulatory authority for human or veterinary use;
(b) Intended for diagnosis, treatment, cure, prevention, or mitigation of any disease or medical condition;
(c) Drugs, dietary supplements, food, cosmetics, or medical devices as defined under any applicable law;
(d) Sold with any express or implied claim of safety or efficacy for human or animal consumption.
Products are research compounds supplied as reference standards and analytical materials. ComfortLore makes no claims regarding the physiological effects, therapeutic potential, or biological activity of any product when used outside controlled laboratory research settings.
3. No Medical Advice or Claims
ComfortLore does not provide medical, health, nutritional, dietary, or pharmaceutical advice. Information provided on the Site, in product descriptions, in blog content, or in customer communications is for informational and educational purposes only and is not intended to substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of a qualified licensed physician or other qualified health provider regarding any medical condition or before making any health-related decisions. Never disregard professional medical advice or delay seeking it because of information obtained from the Site.
4. Account Registration
To purchase products, you may be required to create an account. You agree to:
(a) Provide accurate, current, and complete information during registration;
(b) Maintain and update your information to keep it accurate;
(c) Maintain the security of your account credentials;
(d) Accept responsibility for all activities under your account;
(e) Notify us immediately of any unauthorized access.
We reserve the right to suspend or terminate accounts at our sole discretion, including for violations of these Terms.
5. Orders, Pricing, and Payment
(a) All orders are subject to acceptance and product availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, regulatory concerns, or shipping restrictions in your jurisdiction.
(b) Prices are listed in U.S. Dollars and are subject to change without notice. Applicable taxes and shipping charges are added at checkout.
(c) Payment is required at the time of order. We accept payment methods as listed at checkout, which may include cryptocurrency, credit/debit cards, and other methods.
(d) For cryptocurrency payments, exchange rate fluctuations may cause the displayed price to differ slightly from the amount received. Orders are confirmed once blockchain confirmation occurs.
(e) Your purchase constitutes your acknowledgment of all terms and disclaimers, including the Research Use Only nature of all products.
6. Shipping and Risk of Loss
(a) We ship to addresses where research-grade compounds may legally be received. We do not ship to jurisdictions where importation or possession of our products is restricted.
(b) Shipping times are estimates and not guarantees. Delays may occur due to carrier issues, customs processing, or other factors beyond our control.
(c) Risk of loss and title for products pass to you upon delivery to the carrier.
(d) You are responsible for compliance with any import laws and customs requirements applicable to your jurisdiction.
(e) Lost, stolen, or damaged shipments must be reported within 7 days of expected delivery. We will work with carriers to investigate but cannot guarantee replacement for confirmed delivered shipments.
7. Returns and Refunds
Due to the nature of research-grade biochemical products and to ensure quality integrity:
(a) Unopened products: May be returned within 7 days of delivery for a refund, less original shipping costs. Customer pays return shipping. Products must be in original sealed packaging.
(b) Opened products: Not eligible for return or refund.
(c) Damaged or defective products: Contact us within 48 hours of delivery with photographic evidence. We will arrange a replacement or refund at our discretion.
(d) Wrong items shipped: We will replace at no cost; original product must be returned unopened.
(e) Refunds for cryptocurrency payments: Refunds are issued in the same cryptocurrency at the USD value calculated at the time of refund processing, which may differ from your original payment amount due to exchange rate fluctuations.
(f) Refunds are processed within 7-10 business days of receiving the returned product.
(g) Some products are non-returnable, including custom orders and items marked “Final Sale” at checkout.
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, product descriptions, and software, is the property of ComfortLore LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or use any content from the Site without our express written permission, except as permitted by fair use.
9. Prohibited Conduct
You agree NOT to:
(a) Use the Site or products for any unlawful purpose;
(b) Resell, redistribute, or transfer products to consumers for human or animal use;
(c) Make any medical, therapeutic, or health claims regarding our products;
(d) Submit false or misleading information when ordering;
(e) Use bots, scrapers, or automated tools to access the Site;
(f) Attempt to gain unauthorized access to any portion of the Site or accounts;
(g) Engage in fraudulent payment practices or chargeback abuse;
(h) Use the Site to harass, abuse, or harm any person.
Violation of any of these prohibitions may result in immediate account termination, order cancellation, and legal action.
10. Disclaimer of Warranties
THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
(a) The Site will be uninterrupted, secure, or error-free;
(b) Products are suitable for any particular use beyond laboratory research;
(c) Information on the Site is complete, accurate, or current;
(d) Any defects will be corrected.
YOU ASSUME ALL RISK ASSOCIATED WITH USE OF THE SITE AND ANY PRODUCT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMFORTLORE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:
(a) Any indirect, incidental, special, consequential, exemplary, or punitive damages;
(b) Loss of profits, revenue, data, or use;
(c) Damages arising from misuse of products, including human or animal consumption;
(d) Damages exceeding the amount paid by you for the specific product giving rise to the claim.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless ComfortLore LLC, its members, officers, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:
(a) Your use or misuse of any product;
(b) Your violation of these Terms;
(c) Your violation of any law or regulation;
(d) Your violation of any third party right, including privacy, intellectual property, or publicity rights;
(e) Any human or animal consumption of products purchased from us, regardless of fault;
(f) Any false representation made by you regarding eligibility, research use, or otherwise.
13. Termination
We reserve the right to terminate or suspend your access to the Site and your account at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site ceases immediately. Sections 2, 7, 10, 11, 12, 14, 15, 16, and 17 survive termination.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
15. Dispute Resolution and Arbitration
(a) Informal Resolution: Before initiating any formal dispute, you agree to first contact us at legal@comfortlore.com and attempt to resolve the dispute informally for at least 30 days.
(b) Binding Arbitration: Any dispute not resolved informally shall be resolved through binding individual arbitration administered by JAMS or the American Arbitration Association under their respective rules. Arbitration shall be conducted in Orange County, California, in English.
(c) Class Action Waiver: You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.
(d) Exceptions: Either party may bring an action in small claims court or seek injunctive relief for intellectual property infringement.
16. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site. Material changes will be communicated by updating the “Last Updated” date. Your continued use of the Site or purchase of products after changes constitutes acceptance.
17. Miscellaneous
(a) Severability: If any provision is found invalid, the remaining provisions remain in effect.
(b) Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ComfortLore regarding the Site.
(c) No Waiver: Failure to enforce any right does not waive it.
(d) Assignment: You may not assign these Terms. We may assign them to any successor.
(e) Force Majeure: We are not liable for delays or failures due to events beyond reasonable control.
(f) Notices: Notices to us must be sent to legal@comfortlore.com. Notices to you will be sent to the email associated with your account.
(g) Headings: Section headings are for convenience only and do not affect interpretation.
